Terms of Service
1. Introduction and Scope
These Terms apply to your use of the Services and to purchases made through the website. They should be read together with the policies that govern specific aspects of a transaction, including shipping, order cancellation, returns and refunds, and privacy.
We may revise these Terms from time to time to reflect changes to our Services, business operations, or legal requirements. When required by applicable law, we will provide notice of material changes using an appropriate method. The revised Terms will identify their effective date. Changes will not retroactively alter completed transactions or remove accrued rights where applicable law prohibits doing so.
The version applicable to a particular order will be determined in accordance with applicable law, the terms presented during the transaction, and any valid agreement between you and us. If you have questions about which version applies, contact customer service.
2. User Accounts and Website Responsibilities
Some website features may allow you to create or use an account. If you provide information when creating an account, checking out, or contacting us, you agree to provide information that is accurate and to update it when reasonably necessary to complete your transaction or respond to your request.
If you have an account, you should take reasonable steps to protect your login credentials and notify us if you believe your account has been accessed without authorization. Responsibility for activity associated with an account will be determined under applicable law and the circumstances; these Terms do not automatically make you responsible for every unauthorized transaction.
You agree not to use the Services to:
- Commit fraud or engage in other unlawful activity.
- Attempt unauthorized access to the website, accounts, systems, or data.
- Interfere with the website’s operation, security, or availability.
- Misuse ordering, payment, promotional, or other website functionality.
- Submit false, misleading, infringing, or unlawful content or information.
- Introduce malicious code or engage in conduct that could harm the Services or other users.
We may investigate suspected misuse and take reasonable action, including restricting access or suspending or terminating an account, where justified and permitted by applicable law. We will consider relevant contractual obligations and any procedures or notices required by law.
We aim to keep the Services available and functioning, but uninterrupted access cannot be guaranteed. Maintenance, updates, service-provider issues, connectivity problems, security events, and other technical or operational circumstances may temporarily affect access or functionality. We may make reasonable changes to the Services, subject to applicable law and any obligations relating to an existing order.
You are responsible for using the Services lawfully and providing information reasonably necessary for your transactions. We are responsible for operating the Services and handling transactions in accordance with applicable law and the commitments that apply to your order.
3. Products, Inventory, and Pricing
We make reasonable efforts to describe and display products accurately. Product listings may include photographs, dimensions, materials, colors, specifications, and other information intended to help you make an informed purchasing decision. Please review the listing and order details carefully before submitting an order.
The appearance of a product may vary slightly because of lighting, photography, display settings, manufacturing variations, or similar factors. These possible differences do not excuse materially inaccurate descriptions or limit rights available to you under applicable law.
Product availability may change. An item shown on the website may become unavailable or may no longer be offered before an order is completed. If we cannot fulfill an order because an item is unavailable, we will address the order and any payment collected in accordance with the applicable order terms, published policies, and law.
Prices, discounts, promotions, shipping charges, and applicable taxes will be presented through the website’s listing and checkout process. Review the final order summary before submitting your order. The amount payable will be determined by the price and charges properly disclosed and applicable to your transaction, subject to applicable law.
We make reasonable efforts to maintain accurate product listings, prices, and inventory information. If we identify an apparent error, we may take reasonable steps to correct it. If an error affects an order already submitted or accepted, we will handle the matter in accordance with applicable law and the circumstances of the transaction. We will not rely on this provision to disregard obligations that have already become binding or to remove non-waivable consumer rights.
If a product is discontinued or becomes unavailable after you place an order, we may contact you about the available options. Any cancellation, refund, or other remedy will be handled in accordance with the applicable policy and law.
4. Orders and Payment
When you submit an order, you are making a purchase request for the products and quantities shown in your checkout summary. Submission of an order, an automated acknowledgment, and acceptance of an order are not necessarily the same event. Whether and when an order is accepted depends on the actual checkout process, the communications provided to you, and applicable law.
We may decline or seek clarification about an order where there is a legitimate reason, such as suspected fraud, a payment authorization failure, a material listing or inventory error, or an inability to fulfill the order. Any decision to reject or cancel an order will be subject to applicable law, existing contractual obligations, and the applicable order policies.
You are responsible for providing accurate billing, delivery, and contact information and for using a valid payment method accepted at checkout. Payment may require authorization and completion through the payment method or service made available during checkout. The available payment methods and any additional payment terms are those actually presented during the transaction.
Before submitting your order, review the product details, quantities, applicable taxes, shipping charges, discounts, and final total displayed at checkout. If you identify an error, correct it before submission where the checkout process allows. If you discover an error after submission, contact customer service promptly. We will review the request and explain any available options under the applicable policies and law.
If payment fails, an order appears to be duplicated, or an order cannot be fulfilled, we will address the matter based on the circumstances and applicable law. If payment has been collected for an order that we cannot fulfill, any refund due will be handled in accordance with the applicable policy and legal requirements.
Order cancellation and refund decisions must be consistent with the Order Cancellation Policy and the Return & Refund Policy, as applicable. Nothing in these Terms limits a remedy required by law.
5. Shipping and Delivery
We currently offer shipping within the United States. Standard shipping charges and delivery estimates are as follows:
- Orders below $89.99: Standard shipping costs $7.90.
- Orders totaling $89.99 or more: Standard shipping is free, including when the eligible order total is exactly $89.99.
- Order processing: Generally 2–3 business days.
- Estimated transit time after shipment: Generally 7–9 business days.
These are estimates, not guaranteed delivery dates. Under normal conditions, processing and transit together may take approximately 9–12 business days. Actual timing may vary depending on order circumstances, carrier operations, weather, holidays, operational disruptions, and other factors.
The free-shipping threshold and the amount used to determine eligibility are subject to the calculation described in the published Shipping Policy and the checkout summary. Review the shipping charge shown before placing your order.
We will handle delivery issues and any applicable remedies in accordance with the order terms, published policies, and applicable law. Delays outside our reasonable control do not eliminate rights or remedies that the law requires us to provide. Responsibility for loss or damage during shipment will be determined under applicable law and the circumstances of the transaction.
6. Order Cancellation
You may contact customer service to request cancellation before your order ships. Please contact us as promptly as possible by email or phone and provide your order number and reasonable information needed to locate and verify the order.
A cancellation request is not approved until we confirm that it has been accepted. We cannot promise that every request will be approved, particularly if the order has already entered a stage where cancellation is no longer reasonably available.
Once an order has shipped, ordinary cancellation is generally unavailable. You may need to follow the Return & Refund Policy after delivery, subject to its terms and any rights or remedies available under applicable law.
If we approve a cancellation and a refund is due, the refund will ordinarily be returned to the original payment method, subject to applicable law and the arrangements of the payment service provider. The time required for the funds to appear in your account depends on the relevant bank, card issuer, or payment provider; we do not guarantee a fixed posting time.
For further details, please refer to the Order Cancellation Policy.
The ordinary cancellation process does not limit any mandatory statutory cancellation rights or other remedies that cannot lawfully be excluded.
7. Returns, Exchanges, and Refunds
Returns, exchanges, and refunds are governed by the applicable eligibility requirements and procedures in the published Return & Refund Policy, together with any rights and remedies provided by law.
Before returning an item, review the applicable policy and contact customer service as directed there. Return eligibility may depend on the time since delivery, product condition, packaging, the reason for the return, and other requirements stated in the published policy. Do not send an item back until you have reviewed the applicable instructions.
The published policy will govern the process for requesting a return or exchange, any return-label procedure, responsibility for return shipping costs, and the handling of damaged, defective, incorrect, missing, or otherwise ineligible items. We will not impose a requirement or fee that is inconsistent with the applicable policy or law.
Where a refund is approved, it will be processed using the method and arrangements specified by the applicable policy and law. The time required for a refund to appear may depend on the payment method, financial institution, or payment service provider.
For full details, please refer to the Return & Refund Policy.
Any commercial return policy described on the website is separate from statutory rights and remedies. Nothing in these Terms is intended to waive or restrict a right that cannot lawfully be waived or restricted.
8. Privacy and Data Protection
Our Privacy Policy describes how personal information may be collected, used, disclosed, and retained in connection with the Services. It explains that information may be collected directly from you, automatically through the website and cookies or similar technologies, and from service providers, partners, or other third parties.
Depending on how you interact with the Services, information may include contact and delivery details, payment and transaction information, account details, communications with customer service, device information, and website usage information. We may use such information to process orders and payments, arrange delivery, administer accounts, respond to inquiries, maintain security, improve the Services, communicate with you, and carry out marketing or advertising activities as described in the Privacy Policy.
Information may be disclosed to Shopify and other service providers that support activities such as payment processing, shipping, technology, analytics, customer support, and hosting. The Privacy Policy also describes certain disclosures to business and marketing partners and other disclosures permitted under its terms and applicable law.
The Privacy Policy explains that retention depends on factors such as account administration, service delivery, legal obligations, dispute resolution, and enforcement of applicable agreements. It does not promise perfect security. Depending on where you live and the circumstances, you may have privacy rights or choices concerning access, deletion, correction, portability, targeted advertising, or marketing communications. Requests and opt-out options are subject to applicable law and the procedures described in that policy.
These Terms do not replace the Privacy Policy. If there is a conflict concerning the collection, processing, or disclosure of personal information, the Privacy Policy states that it controls on those subjects. Applicable law will continue to govern where required.
9. Disputes and Governing Law
If you have a concern about an order or the Services, we encourage you to contact customer service first so that we can try to resolve the matter informally. This does not prevent you from exercising any legal rights or pursuing remedies available to you.
The governing law and forum for a particular dispute will be determined by applicable law and any valid contractual provision that applies to the transaction. Our mailing address in Florida does not, by itself, determine which law governs every transaction or where every dispute must be heard.
Nothing in these Terms is intended to prevent a consumer from bringing a claim in a forum where applicable law gives that consumer the right to do so, or to displace mandatory consumer protections. No arbitration requirement, class-action waiver, or exclusive venue restriction is created by this section.
Any more specific governing-law or dispute-resolution provision should be added only after the relevant customer markets and legal requirements have been reviewed.
10. Intellectual Property and Website Content
Website content, including text, product photographs, graphics, page layouts, logos, and other materials, may be owned by us or used with permission from the relevant rights holder. Ownership and permitted use depend on the rights applicable to each item of content.
Except as permitted by applicable law or with authorization from the relevant rights holder, you may not reproduce, distribute, modify, publicly display, or commercially exploit website content in a manner that infringes intellectual-property rights.
Nothing in these Terms transfers to you ownership of intellectual property belonging to us or a third party. If you believe material on the website infringes your rights, contact customer service with sufficient information for us to identify and review the concern.
11. Disclaimers and Limitations of Liability
We aim to provide useful product information and a functioning online shopping experience. However, to the extent permitted by law, the Services may occasionally be unavailable, interrupted, or affected by technical errors, and website information may require correction or updating.
Nothing in these Terms excludes or limits a warranty, liability, obligation, or remedy that cannot lawfully be excluded or limited. Nothing here removes rights relating to defective or misdescribed products, legally actionable conduct, or other protections that applicable law makes mandatory.
To the extent permitted by applicable law, we are not responsible for losses caused by circumstances beyond our reasonable control, such as certain third-party service interruptions or carrier delays. This provision applies only to the extent the law permits and does not excuse obligations that remain our responsibility.
To the extent permitted by applicable law, liability for a particular claim will be assessed in light of the facts, the nature of the claim, and any valid limitation that lawfully applies. We do not use these Terms to establish a blanket exclusion of liability for all losses, injuries, transactions, or products.
Any additional limitation of liability or warranty disclaimer must be consistent with applicable law, the actual products and services offered, and any express or implied warranties or statutory protections that apply.
12. Changes to These Terms
We may update these Terms from time to time. The current version will display its effective date. When applicable law requires notice of a material change, we will provide notice by an appropriate method and, where required, obtain any necessary acceptance.
Changes will apply prospectively to the extent required by law. They will not retroactively modify completed transactions, remove accrued rights, or alter existing orders in a manner prohibited by law.
You should review the current Terms when using the Services or placing a new order. Where affirmative acceptance is legally required, continued use alone will not replace that requirement.
13. Severability and Other Contractual Provisions
Severability. If a provision of these Terms is found to be invalid or unenforceable, it will be applied to the extent permitted by law, and the remaining provisions will continue to apply to the extent they can operate independently.
No waiver. A failure or delay in exercising a right under these Terms does not necessarily waive that right. Any waiver will be effective only to the extent permitted by applicable law and the circumstances.
Assignment. Any assignment of rights or obligations under these Terms must comply with applicable law and any contractual requirements that apply. Nothing in this section authorizes a transfer that would unlawfully affect your rights.
Related policies. The Shipping Policy governs shipping details; the Order Cancellation Policy governs ordinary cancellation requests; the Return & Refund Policy governs commercial return and refund procedures; and the Privacy Policy describes personal-information practices. These Terms should be read consistently with those policies and with applicable law. If provisions appear to conflict, the relevant transaction terms, the policy addressing the specific subject, and mandatory legal requirements should be considered together. No provision automatically overrides another where doing so would conflict with applicable law or an existing contractual obligation.
Entire agreement and mandatory rights. These Terms, together with any applicable order terms and relevant published policies, describe the terms applicable to your use of the Services and your transactions, subject to applicable law. They do not remove rights that cannot lawfully be waived or exclude any mandatory legal obligation.
